Carol Burnett’s controversial daughter Erin Hamilton, who has been in and out of rehab over the years due to substance abuse, recently had a brush with the law. A court document has revealed that a judge from the Los Angeles Superior Court has now revoked all of Hamilton’s visitation rights with her 16-year-old son, Dylan, due to a petition filed by his court-appointed lawyer, who claimed that she violated a court order.
In August 2020, Burnett and her current husband, Brian Miller, petitioned to be granted legal guardianship of her grandson. “Due to addiction issues and other circumstances that my daughter, Erin, has been struggling with impacting her immediate family dynamic, my husband and I have petitioned the court to be appointed legal guardian of my 14-year-old grandson,” Burnett stated.
Burnett’s daughter breached her visitation agreement
The couple was granted temporary guardianship of Dylan in September 2020, but in 2022, Jodi Pais Montgomery, who had worked with Jamie Spears during Britney Spears’s conservatorship, was named the permanent guardian. However, Erin was legally awarded monitored visitation once weekly for two hours — the agreement that she has been accused of breaching.

Dylan’s court-appointed lawyer mentioned in a report that after the appointment of a permanent guardian, things had been running smoothly with the conservatorship as Montgomery ensured that Erin had regular visits with her son. But things took a different turn when Erin secretly returned to California from Hawaii, where she had been residing, without notifying Montgomery. In August, she had dinner with Dylan and his father at a restaurant, where she unexpectedly encountered them.
The attorney stated that the unmonitored meeting was a total breach of the provisions of the visitation order. “This incident is a brazen violation of this court’s orders by mother,” she said. “It is unclear why mother acts as if the clear and specific orders made by this court do not apply to her.”
Court temporarily revokes Erin Hamilton’s visitation rights
In her court petition, the attorney expressed her astonishment at how Erin learned about Dylan’s whereabouts and requested the court temporarily halt her visitation privileges while citing her addiction battle. She also asked that the court order regular mandatory drug tests for Erin based on her history.
“Mother has a long history of struggling with substance use, it is unknown if the mother is clean and sober at this time,” the lawyer stated. “Any missed tests to be considered dirty tests. Costs of the random, weekly testing to be borne by mother.” The judge gave a verdict that supported the attorney’s request, and Erin has temporarily been barred from visiting Dylan until the court resumes hearings in January.
